Garantizar desde el área de personas el cumplimiento de las obligaciones legales, contractuales y reglamentarias en materia laboral y previsional de

1.- Control documental
- Solicitar, revisar y validar periódicamente certificados de cumplimiento de cotizaciones previsionales (AFP, AFC, Isapre/Fonasa, mutualidades).
- Verificar la existencia de contratos de trabajo, anexos y finiquitos debidamente firmados y registrados.
- Revisar certificados emitidos por la Dirección del Trabajo, Tesorería General de la República u otras entidades.

Evitar responsabilidad solidaria o subsidiaria que establece la normativa en caso de incumplimientos por parte de las EECC y/o Subcontratistas.
- ON*NET FIBRA no asume deudas por sus contratistas en materias de cotizaciones previsionales y laborales.

2.- Supervisión de obligaciones laborales
- Controlar que los contratistas cumplan con las normativas sobre jornadas laborales, descansos, remuneraciones, feriados y demás disposiciones legales.
- Asegurar que la documentación laboral se encuentre actualizada y ajustada a la normativa vigente.

Resguardar continuidad operativa
- Al controlar que no existan conflictos laborales (huelgas, demandas, incumplimientos), se asegura que las obras o servicios no se vean interrumpidos.

Gestión preventiva y de control

- Mantener un sistema de alertas tempranas para detectar incumplimientos laborales y previsionales.
- Informar oportunamente a las jefaturas sobre irregularidades detectadas y proponer medidas correctivas.
- Recomendar la retención de pagos en casos de incumplimiento, conforme a la Ley 20.123.

Cumplir con la normativa vigente (Ley 20.123 y Código del Trabajo)
- Evita multas y sanciones de la Dirección del Trabajo u otros entes fiscalizadores.


- Prevenir la desnaturalización en los procesos de subcontratación.
- Aplicar las facultades establecidas en la Ley de Subcontratación acerca de las retenciones monetarias en caso de incumplimientos de obligaciones previsionales y laborales

Relación con organismos externos

- Coordinar con la Dirección del Trabajo, AFP, AFC y entidades fiscalizadoras la validación de información cuando sea necesario.
- Revisar los procesos de certificación laboral y previsional de las EECC y Subcontratistas en CERTILAP
- Dar soporte en auditorías laborales y previsionales.

Asegurar transparencia y confianza en la relación contractual
- Genera trazabilidad y respaldo documental que demuestra el cumplimiento legal de todos los participantes en la cadena de subcontratación.
- Asegurar la emisión de certificados mensuales que acrediten el cumplimiento de las obligaciones laborales y previsionales de las EECC y Subcontratistas.

5.

Gestión contractual y respaldo legal

- Apoyar la elaboración y revisión de contratos con EECC incorporando cláusulas de cumplimiento laboral y previsional.
- Mantener registros y respaldos documentales que resguarden a la empresa mandante frente a responsabilidades legales.

Cuidar la reputación corporativa
- Garantiza que ON*NET FIBRA no se vea asociada a prácticas laborales indebidas por parte de sus empresas contratistas y subcontratistas.

Re portabilidad

- Elaborar reportes de gestión precisos y oportunos acerca del comportamiento de cada EECC y Subcontratista, aportando información clave para la toma de decisiones.
- Actualización de la información y bases de datos, asegurando la disponibilidad y confiabilidad de los datos.

Disponibilidad de información fidedigna
- Oportunidad de considerar comportamiento y responsabilidad de las empresas en el cumplimiento de obligaciones laborales y previsionales al momento de asignarles trabajos.
